FAQ

1 — Identification of the Merchant

The merchant Website is an e-commerce website accessible via the Internet, open to any user of this network. It is edited by Eric Beauduin, whose operational headquarters is located at Chaussée de Charleroi 229, 1060 Brussels (Belgium), registered with the Crossroads Bank for Enterprises under the number BE0560 545 677.

2 — Subject

These terms and conditions are intended to define the rights and obligations of the Parties arising from the sale of the Products offered on the Website.

3 — Essential characteristics of the Products offered for sale

The key features of each Product are described on the relevant pages of the electronic catalog of the Website. The photographs presenting the products offered on the Website are not contractual and cannot engage the responsibility of the Website.
The offer referred to in these terms and conditions and the delivery of the Products are available for the following countries:

4 — Detailed breakdown of the price of the good

Subject to Article 5, the prices quoted at the end of the ordering process are the total prices and include VAT.
The price is expressed in euros ().
Only payments in euros () are accepted.
The Customer guarantees that it has the necessary permissions to use its chosen payment method.
The Website takes every necessary step to ensure the security and confidentiality of the data transmitted online. The Website has opted exclusively for payment by credit card via a specialized body that encrypts all of your information related to the card use during the online payment transaction via the Website. Accordingly, the transaction takes place via a specialized organization that is the only organization that has the bank details provided on the Website at the time of payment.
The order will be processed after reception of the approval from the aforementioned specialized agency.
The Website cannot be held responsible for the consequences of any use (fraudulent or otherwise) of the credit card by a third party, especially in the event of intercepted messages.
The Website may issue an electronic invoice. The Buyer must specify the email address to which the invoice should be sent.

5 — VAT Payment Terms

HT = Hors Taxes (ex-tax); TTC= Toutes Taxes Comprises (including all taxes).
Unless otherwise stated, the prices quoted on the Website include Belgian VAT.

Shipping in Belgium:
Individuals and companies: the sale includes VAT; Belgian VAT of 21% is included.

Shipping to another country that is a member of the European Community:
Individuals: the sale includes VAT; Belgian VAT of 21% is included.
Companies: the sale does not include VAT (subject to provision of a compliant VAT number).

Article 6 — Shipping costs

Deliveries are made to the following countries:

They are insured by La Poste in Belgium and the other countries.
Shipping fees are borne by the Buyer and the price is that charged by b-post.
The package is insured by us throughout its transport until the Buyer takes possession of it.
To ensure their perfect condition and perfect security during transport, all the Products are carefully packaged and protected according to current standards.

7 — Conclusion of the contract online

The User can become acquainted with the various Products offered for sale on the Website.
The User can freely browse the various pages of the Website with no order commitment.
If the User wishes to place an order, it shall choose the various Products in which it is interested, expressing such interest by clicking on the box "Add to cart".
Each new addition to its cart will be indicated by the appearance of a specific screen.

At any time, the User may:
Obtain a summary of the Products it has selected by clicking on "Cart",
continue to select Products by clicking on "Continue Shopping",
complete its Product selection process and order these Products by clicking on "Checkout".
The order is only placed after the accuracy of the information provided has been confirmed. This acceptance of the order is made final by clicking the order submit button.
The Website acknowledges receipt of the order as soon as possible via an e-mail detailing the purchases that is sent to the email address provided by the Buyer at the time of the order confirmation.
When entering its order, the Buyer is informed of the availability of the Product. If the order cannot be fulfilled, the Website shall inform the Buyer as soon as possible.

8 — Online payment

The Website has opted exclusively for payment by credit card via the secure payment system Ingenico that encrypts all of your information related to the card use during the online payment transaction via the Website. 
The cards accepted by the Website are: Visa, MasterCard / Eurocard or Bancontact, Maestro. On the online payment page, you will be asked to enter your credit card number, expiration date and security code (3-digit number on the back of your credit card).
The Website cannot be held responsible for the consequences of any use (fraudulent or otherwise) of the credit card by a third party, especially in the event of intercepted messages.
When paying, the Buyer is directed to the secure site Ingenico for the entire payment transaction. This mechanism ensures the confidentiality of the payment information (including credit card numbers). Thus the Website is not aware of the Buyer's credit card number at any time; only the financial institution receives it in encrypted form. The Website has a certificate issued by Verisign that confirms the reality of the existence of Ingenico and the use of an SSL certificate to encrypt confidential data.
Once the payment has been accepted and confirmed, Ingenico verifies and carries out the online payment.

9 — Withdrawal period

Under Belgian law, any Buyer established in Belgium is entitled to notify the Website that it waives its purchase no later than 14 calendar days following its order. The Buyer in question must include in the parcel a copy of its Order or invoice. The Website will refund the price of the Product within 30 days without prejudice to the application of the provisions of Article 10.
This provision applies to any Buyer enjoying the same protection in its country of residence.
If a Buyer exercises this right, the terms of Article 10 apply.

10 — Terms for returns

Returns under Article 9 above will only be accepted and reimbursed or exchanged if our sales representatives confirm that the Product corresponds to the one that was sent and has not been damaged, modified or affected in any way.
Only Products returned in their original packaging will be subject to exchange or refund. Products that are damaged, soiled, or show wear will be returned to the sender.
If a Buyer exercises the right of withdrawal pursuant to Article 9, the cost of returning the Product(s) to the sender is free for the first return under condition that the same courier that delivered the Product(s) that are being returned is used. From the second return of the same Buyer, the return costs are borne by the Buyer.

11 — Delivery of the good

The Website will do all that is reasonable to deliver the Products in a timely manner. Unless the Parties agree otherwise, the delivery will take place at the latest within 30 days from the day after the day on which the Buyer transmitted its order.
The products are delivered to the delivery address specified by the Buyer during the ordering process. The courier will only deliver the parcel upon presentation of an official identity document and after the Buyer has signed a bill of delivery for the perfect receipt.
The Buyer must always verify the package and Product on delivery. If the Buyer finds apparent damage upon delivery, it must note it immediately on the bill of delivery before signing it for receipt. In any case, in the event of visible or hidden damage, it must provide notice of its claim by email (contact@ericbeauduin.be) and registered mail [Eric Beauduin, 229 Chaussée de Charleroi, 1060 Brussels, Belgium], within 15 days (including public holidays) from the date of delivery (as evidenced by the postmark). After this period, no claim will be admissible.
If by an extraordinary turn of events, the Buyer does not receive its delivery in the month following its order, it is requested to notify the Merchant immediately by email (contact@ericbeauduin.be).

12 — Ownership Risks

The transfer of ownership of the Product to the Buyer will only occur after full payment of the price by the latter and irrespective of the date of delivery of the Product in question. However, the transfer of risk of loss and deterioration of the Product occurs upon delivery and receipt of the Product in question by the Buyer. The date on the bill of delivery is evidence of the delivery date.

13 — Warranty

Each Product is carefully inspected before shipment. The Buyer must perform a similar inspection at the time of receipt. Claims must be made in accordance with Article 11.
The Website endeavors to describe and present the products with the greatest accuracy. However, it is impossible to reproduce the actual color of the Products on a screen. Additionally, the rendering of the color depends on the hardware used by the customer. As such, the responsibility of the Website may not be engaged with regard to the reliability of the colors. Similarly, the Buyer is hereby reminded that Eric Beauduin products are unique pieces using second-hand leather and fabric clothing. Patina and traces of wear on these materials cannot be considered as defects in the event of a return. The documents associated with the products are therefore only provided for information purposes and are not contractual. The Website does not accept claims nor provide guarantee in the event of dissatisfaction regarding the color, patina and traces of wear of second-hand materials and the descriptions.
The Website is in no way responsible for any delay in the execution of an Order or any non-execution of an Order if the delay or non-execution is due to a technical reason or other reason beyond its control. In this event, the Website is entitled to delay the transportation and delivery of an Order or simply cancel any pending Order within reason and as necessary.
No claim can be sent and no guarantee will be granted beyond the period stipulated in Article 11.
The aforementioned guarantees are exhaustive and replace all other guarantees, whether express or implied.

14 — Personal data

The Website complies with the Belgian law of 8 December 1992 regarding the processing of personal data for all processing and collection of data in Belgium via the Website and included in the files of the Website.
Under this law, each User has the right to view, delete, modify or correct the information pertaining to it. The User can consult, delete, modify or correct this information by sending an email (contact@ericbeauduin.be) or by writing to the Website whose address can be found above.
The information collected at the time of order is solely intended to better serve the User. The order and the acknowledgment of receipt sent to the Buyer are archived for a period of ten years from the delivery of the products ordered but is not made available to third parties. The Website guarantees that it will keep the information made available to it during the execution of this order strictly confidential and will not disclose it to anyone during the execution of the order nor after its termination.

15 — Intellectual property

The Website and all its elements are protected by applicable intellectual property laws. They are the exclusive property of Eric Beauduin. This Website is reserved for strictly personal use. Any reproduction or public communication of the brands, texts, photographs or other material posted on the Website is strictly prohibited without the express prior written permission of Eric Beauduin. Any hypertext link directly to this Website must be the object of his express prior authorization.

16 — Evidence

The records stored in the Website computer systems in reasonably secure conditions will be considered evidence of communication, orders and payments between the Parties.
Purchase orders and invoices are saved on a reliable and durable medium that can be produced as evidence.

17 — Acceptance of the terms and conditions

These terms and conditions apply to all the offers, sales, purchases and other transactions whatsoever occurring between the Parties.
Consequently, by the very fact of calling on and/or using the services of ericbeauduin.be, placing an order and/or entering into any contract, the User irrevocably acknowledges to have received a copy of these terms and conditions and that they are enforceable against it and it accepts their application to the exclusion of all others. The general or specific User terms and conditions are never applicable without the express prior written consent of Eric Beauduin.
These terms and conditions can be viewed on the page [page]. If the User wishes, it can download, print and store a copy of them.
These terms and conditions may be modified in the future. The User tacitly accepts each change by continuing to use and visit the website www.ericbeauduin.be. It is the User's responsibility to regularly acquaint itself with the new terms and conditions.
The Website prompts the User to read the terms and conditions and accept them by clicking "I AGREE" at the bottom of the terms and conditions in order to continue its purchase. Failing to do so will prevent the User from being able to proceed with the payment of its purchases.
The fact that the User does not read the Website terms and conditions in its native language does not exempt it from their application. The terms and conditions are available in English.

18 — Applicable law and competent courts

These general terms and conditions are governed by Belgian law. The Parties agree that any dispute related to these terms and conditions is the exclusive jurisdiction of the Courts of Brussels.
